The News & Observer: Teen won’t be charged in bicyclist death

The State Highway Patrol will not file charges against a 17-year-old whose pickup truck struck and killed a teen bicyclist last week.

“None are expected to be filed,” Sgt. V.E. Terry with the Highway Patrol said today.

The accident occurred Saturday just after 6 p.m. on an Interstate 95 Service Road in Dunn, Terry reported.

Terry said Devin Vonscott Ray, 16, of 52 Harvey Allen Lane in Dunn was bicycling south of the travel road when a 1996 Ford truck clipped the biker from the rear. The truck then ran over the top of Ray, Terry said.

The driver of the pickup truck was Michael L. Jackson of Dunn. An accident report did not indicate if the teens knew one another, Terry said.

Emergency workers transported Ray to Betsy Johnson Hospital in Dunn, where he was pronounced dead, Terry said.

The posted speed limit on the service road is 55 mph. Jackson was traveling the normal speed limit. Drugs or alcohol were not factors in the collision, the patrol reported.

Terry noted that Ray was riding the bicycle in the roadway and that it was already dark outside.
