Foster’s Daily Democrat: Three charged after Rye road rage incident involving car and bicycles

RYE— Three men are facing charges in connection with a September road rage incident in which a pair of bicyclists allegedly ambushed a motorist with whom they’d had an encounter on Ocean Boulevard (Route 1A).
Police say the incident in question took place on Sept. 9. Police were called to the scene at 6:45 p.m.
Rye Police Chief Kevin Walsh has said police were called to Ocean Boulevard for reports of a motor vehicle that had passed a group of bicyclists. After some “words” and “hand gestures” were exchanged, Walsh said two of the bicyclists took a shortcut through some back roads in an effort to get ahead of the passing vehicle.
Once in front of the motorist, Walsh said the bicyclists laid their bicycles in the travel lane and stood out in the middle of the roadway, stopped the car and then one of them climbed onto the hood of the vehicle with a large rock in his hand.
“We believe there were some words and body language used to indicate that he was threatened,” Walsh said in an earlier interview with Foster’s.
Police have charged three men in connection with the incident. Two are from the biking group and one is the driver of the vehicle.
Duane Foster, 43, of 2 Foyes Road in Rye has been charged with criminal mischief (vandalism), criminal threatening (use of deadly weapon) and disorderly conduct.
Kevin Tonkin, 38, of 298 Newmarket Road in Durham is charged with disorderly conduct.
Tonkin and Foster were biking on the day the incident took place.
Richard MacIntosh, 67, of 29 Fern Ave. in Rye has been charged with violation-level reckless operation.
